SECTION 1 OUTDOOR BURNING REQUIREMENTS

 

(1)   The Fire Inspector, The Chief of Police or any of his officers may revoke this permit at any time for non conformance of the prescribed burn requirements listed with this permit.

(2)   Applicant must notify Cisco Fire Department two hours prior to starting prescribed burn at 254 442 3078. The fire department may postpone a requested burn due to predicted wind speed, wind direction, burn bans or other high fire hazard conditions.

(3)   Burning cannot start before 9 a.m. and must be completed before 5 p.m.

(4)   Burning must be postponed when wind speed is predicted to be greater than 15 mph.

(5)   A burning permit shall apply to one fire and may not be used for and does not authorize successive fires at the same location, unless specified on the permit issued by the City of Cisco.

(6)   Fee of $25.00 will be required when the application is approved.

 

SECTION 2 MATERIALS THAT MAY NOT BE BURNED

 

Unless a specific written approval has been obtained from the Texas Commission on Environmental Quality (TCEQ), the following materials may not be burned in any open fire, incinerator, burn barrel, furnace, stove or any other indoor or outdoor incineration or heating device. The City of Cisco will not issue a permit for burning any of the following materials without air pollution control devices and a copy of written approval from the TCEQ.

1.      Rubbish or garbage including but not limited to food wastes, food wraps, packaging, animal carcasses, paint or painted materials, furniture, composite shingles, construction or demolition debris or other household or business wastes.

2.      Waste oil or other oily wastes except used oil burned in a heating device for energy recovery subject to the restrictions in Chapter 22, TCEQ Regulations on Outdoor Burning.

3.      Asphalt and products containing asphalt.

4.      Treated or painted wood including but not limited to plywood, composite wood products or other wood products that are painted, varnished or treated with preservatives.

5.      Any plastic material, including but not limited to nylon, PVC, ABS, polystyrene or urethane foam, and synthetic fabrics, plastic films and plastic containers.

6.      Rubber, including tires and synthetic rubber-like products.

 

SECTION 3 OPEN BURNING ALLOWED UNDER PERMIT

 

1.      The following types of open, outdoor burning shall be allowed upon issuance of a permit by the City of Cisco:

 

(a)    Open burning of leaves, brush, clean wood and other vegetative debris.

(b)   Open burning of weeds or brush on zoned open agricultural land.

(c)    Burning of trees, limbs, stumps, brush or weeds for clearing or maintenance of right –of-ways.

(d)   Bonfires, if approved by and in accordance with provisions established by the TCEQ and city fire inspector.

 

2.      Open burning under permit shall be conducted in compliance with all local and State fire protection regulations.

3.      No open burning under permit shall be undertaken during periods when any City, County official has issued a burning ban applicable to the area. It will be the responsibility of the person to whom the permit was issued to know when any burning ban applicable to the area has been issued.

4.      All open burning under permit shall be conducted in a safe manner that does not create a nuisance and may be commenced and continued only when wind and weather conditions are such the possible adverse effects are minimized and the burning will not create a health hazard or a visibility hazard on roadways, railroads or airfields or the risk of starting an uncontrolled fire.

5.      Open burning shall be conducted only on the property on which the materials were generated or at a facility approved by and in accordance with provisions established by the TCEQ and the Fire Inspector.

6.      A commercial enterprise, other than an agricultural or silvicultural operation, may conduct an open burn under permit only at a facility approved by and in accordance with provisions established by the TCEQ and the fire inspector.

7.      Open burning under this section shall only be conducted at a location at least one hundred (100) feet from the nearest building which is not on the same property.

8.      No burning allowed under this Section shall be conducted within twenty-five (25) feet from any combustible material, combustible wall or partition, exterior window opening, exit access or exit unless specifically authorized by the fire inspector. Any exception to this provision authorized by the fire inspector shall be included in writing on this burn permit.

9.      Open burning shall be constantly attended and supervised by a competent person of at least 18 years of age until the fire is extinguished and is cold. The person shall have readily available for use such fire extinguisher equipment as may be necessary for the total immediate control of the fire.

10.  No materials may be burned upon any street, curb, gutter or sidewalk or on the ice of a lake, pond, stream or other body of water.

 

SECTION 4 LIABILITY

A person conducting or using an open outdoor fire of any kind shall be responsible for all fire suppression costs and any other liability resulting from damage caused by the fire. The City of Cisco will not be liable for any fire suppression costs or any other liability resulting from damage caused by a fire being conducted under a permit issued by the City.

 

 

 

SECTION 5 RIGHT OF ENTRY AND INSPECTION

The Fire Chief, Police Chief, Fire Inspector or any officer, agent, employee or representative of the City of Cisco who presents credentials may inspect any property for the purpose of ascertaining compliance with the provisions of this permit. Any non-compliance could result to a fine of up to $2000.00, and revocation of the permit.
